CBDT Notification 80/2026: IFSC Units Ko Milega TDS Se Chhutkara

Income-tax Act 2025 ke tehat GIFT City financial services ko naya compliance relief

Agar aap GIFT City IFSC mein kaam karne wali kisi financial services entity se jude hain  ya phir aisi kisi unit ko payment karte hain   toh CBDT ki 10 July 2026 wali Notification No. 80/2026 aapke liye kaafi kaam ki hai. Is notification ne interest, dividend, professional fees, commission aur brokerage jaise kayi payments ko TDS deduction se bahar nikaal diya hai, basharte kuch shartein poori ho.

Chaliye seedhi bhasha mein samajhte hain ki ye notification kehti kya hai, kis par lagu hoti hai, aur agar aap payer ya payee hain toh aapko kya karna hoga.

Ek line mein: Notification 80/2026 ke tehat, eligible IFSC units ko kiye gaye specified financial payments par ab TDS nahi katega  bas payee ko ek declaration form (Form 1(N)) file karna hoga, aur ye chhoot 1 April 2026 se lagu maani jayegi.

Notification 80/2026 Hai Kya?

CBDT ne Notification No. 80/2026 [F. No. 275/19/2026-IT(B)] issue karke ye clarify kiya hai ki International Financial Services Centre (IFSC) mein registered eligible units ko diye jaane wale kuch specified payments  jaise interest, dividend, professional fees, commission aur brokerage ab Income-tax Act, 2025 ke tehat TDS se exempt honge. Ye chhoot Act ke Section 393 ke under aati hai, aur deduction ka fayda Section 147 se link kiya gaya hai.

Simple shabdon mein: agar payer (jo payment kar raha hai) kisi eligible IFSC unit ko in specified categories mein payment kar raha hai, toh usse ab TDS kaatne ki zaroorat nahi  bas ek declaration process follow karna hoga.

Kaunsi 14 Categories Ki IFSC Units Is Chhoot Ke Dayre Mein Aati Hain

Notification ne 14 tarah ki IFSC entities ko notify kiya hai jinke liye ye relief available hai:

Har category ke liye exempt payments alag-alag hain. Jaise ki Banking Units ke case mein, External Commercial Borrowings/loans par interest income, professional fees, referral fees, brokerage income aur factoring-forfaiting services par commission  ye sab TDS se bahar aate hain. Finance Companies aur Finance Units ko external commercial borrowings ke interest, dividend income, aur factoring-forfaiting commission par chhoot milti hai.

Payee Ko Karna Kya Hoga — Form 1(N) Declaration

Ye chhoot automatic nahi hai  payee (yaani IFSC unit) ko payer ke paas ek statement-cum-declaration file karni hogi, jise Form No. 1(N) kaha gaya hai. Is form mein payee ko batana hoga:

  • Kaunse 20 consecutive tax years ke liye woh Section 147 ke tehat deduction claim karna chahta hai
  • Uske paas kaunsa permission ya registration hai
  • Kis tax year se option exercise kiya ja raha hai
  • Initial tax year jisse deduction pehli baar claim kiya gaya tha

Ye declaration Income-tax Act 2025 ke Section 265 ke tehat authorised person dwara sign hona chahiye — matlab wahi vyakti jo return of income sign karne ke liye eligible hai.

Payer Ki Zimmedari Kya Rahegi

Ek baar payer ko ye declaration mil jaaye, uske baad woh us payee ko kiye gaye notified payments par TDS nahi kaat sakta. Lekin isse payer ki reporting duty khatam nahi hoti  usse in payments ki details, jin par TDS nahi kata, Section 397(3)(b) ke tehat prescribed TDS statement mein report karni hongi, Income-tax Rules 2026 ke Rule 219 ke saath.

Jaldi Mein Ye Points Yaad Rakhein

  • Notification effective maani jayegi 1 April 2026 se (retrospective effect, kisi ke liye nuksaandayak nahi)
  • Chhoot sirf un 20 consecutive tax years ke liye hai jo payee ne declare kiye hain
  • Declared period ke baahar kisi bhi year mein payer ko normal tarike se TDS kaatna hi hoga
  • Payer ko har quarter mein non-deduction ki details statement mein report karni zaroori hai
  • Ye chhoot Income-tax Act, 2025 ke transition ka hissa hai, jo purane Section 194 series ke provisions ki jagah le raha hai

Ye Kyu Matter Karta Hai

GIFT City ko global financial hub banane ki koshish mein ye ek aur step hai. Pehle bhi 2025 mein IFSC units ke liye TDS relief diya gaya tha, lekin us waqt ye 10 tax years tak limited tha. Ab Income-tax Act, 2025 ke naye framework mein ye window badhakar 20 consecutive tax years kar di gayi hai — jo long-term financial planning aur compliance ke liye kaafi zyada flexibility deta hai.

Jo bhi businesses IFSC units ko payments karte hain  chahe woh interest ho, professional fees ho ya brokerage  unhe apne vendor/payee documentation process mein ye Form 1(N) declaration shaamil karna hoga, taaki compliance mein koi gap na rahe.

Q1. CBDT Notification 80/2026 kis date se lagu hai?

Ye notification 10 July 2026 ko issue hui thi, lekin deemed effect 1 April 2026 se diya gaya hai  yaani Tax Year 2026-27 se ye applicable maana jayega.

Q2. Kya ye chhoot sabhi IFSC units ke liye hai?

Nahi. Sirf notification mein listed 14 categories ki eligible IFSC entities  jaise Banking Units, Finance Companies, Fund Management Entities aadi  hi is relief ka fayda le sakti hain, woh bhi specified payment types par.

Q3. Payee ko chhoot lene ke liye kya karna hoga?

Payee ko Form No. 1(N) mein statement-cum-declaration file karke payer ko dena hoga, jisme 20 consecutive tax years ka option aur relevant registration details di jaati hain.

Q4. Kya payer ki reporting responsibility bhi khatam ho jaati hai?

Nahi. TDS na kaatne ke baawajood payer ko har quarter ke TDS statement mein in payments ki details report karni hoti hain, jaisa Section 397(3)(b) aur Rule 219 mein bataya gaya hai.

Q5. Agar declared 20 years khatam ho jaayein toh?

Declared period ke baad ya usse bahar ke kisi bhi tax year ke liye payer ko normal provisions ke tehat TDS kaatna zaroori rahega.
