December 31 Marks the Deadline for Belated ITR Filing – Consequences for Missing the Date

As we are reaching the end of the year 2023, individuals who still need to submit their Income Tax Returns (ITRs) for the 2022-2023 financial year need to act promptly. The looming deadline of December 31, 2023, is the last chance to fulfill this requirement, but it carries penalties and interest for those filing late. Filing an ITR is an annual duty mandated by income tax laws, and apart from meeting this obligation, it allows taxpayers to seek refunds for any extra taxes paid or deducted in the fiscal year.

The original deadline for filing Income Tax Returns (ITRs) for the financial year 2022-2023, corresponding to the assessment year 2023-2024, was July 31, 2023. For those who missed this deadline, the last opportunity is December 31. As per Section 234F of the Income Tax Act, late filing incurs a fee of Rs.5,000, reduced to Rs.1,000 for those with total income below Rs.5 lakh. Late filers also face interest under section 234A at 1% per month on unpaid tax.

Filing an updated return does not apply to claiming a tax refund. Failure to file ITR may prevent carrying forward losses, and non-compliance could lead to penalties ranging from 50% to 200% of assessed tax. In severe cases, prosecution is possible.

After December 31, financial implications escalate, including penalties and interest. However, an updated return can be filed within 24 months of the relevant assessment year, though additional income tax applies. The Finance Act, of 2022, introduced updated returns, allowing a longer duration. No penalty or fee is imposed, but additional tax must be paid per Section 140B.
