ITR Filing: Do You Need To Pay Any Penalty For Revising Your Tax Returns?

Q:  I have done made a mistake while filing my income tax returns on the last day 31st of July 2023. Hence, I am thinking to revise my returns. Will there be any penalty for filing a revised return?

I realized I made a mistake in my income tax return (ITR) right on the last day of the deadline, which was July 31. I want to correct it with a revised filing. Will there be a penalty, and when is the deadline for the revised return?

Many taxpayers often find errors in their ITRs, such as wrongly reported incomes, deductions, taxes owed, or selecting the wrong ITR form. 

These mistakes can lead to tax department inquiries or result in a defective ITR. To correct such errors and ensure accurate reporting, the option to file a revised ITR is still available to all taxpayers.

For the fiscal year 2022-23, a revised ITR can be submitted by December 31 without incurring any penalties, after settling any taxes due following the revision. 

However, it's advisable to submit the revised ITR as soon as possible, ideally before receiving any inquiry notice from the tax department regarding the original ITR.

 

Q: My ITR has already been processed, and I received the refund I claimed in the original return. What if I revise my tax return & the refund is not the same?

Revising your ITR is meant to correct any errors in the initial submission. It's important to file a revised return promptly once you have accurate information and identify discrepancies. 

Even if the refund you received matches your initial claim, providing precise income details to tax authorities is crucial, as they might issue notices even after the refund is credited.

If your revised return leads to a smaller refund, the tax department might demand the excess amount back. On the other hand, if the revised return indicates a higher refund, you'll receive the additional amount.
