Tax Audit Deadline: Taxpayers were required to file their tax audit reports by September 30, 2023. The income tax department did not grant an extension, and those who missed this deadline may face penalties. However, not all taxpayers are affected by this.

Individuals who earn income from businesses or professions above a specific threshold are required to undergo a financial audit. For business owners, if your annual sales or income surpasses Rs 1 crore, an audit is mandatory. 

However, if your business largely involves digital transactions with minimal cash dealings, an audit is only necessary if your income exceeds Rs 10 crore.

If you work as a professional, such as a doctor or lawyer, an audit is necessary only if your annual earnings exceed Rs 50 lakh. However, individuals who have opted for the presumptive income tax scheme typically do not need to concern themselves with audits. 

In case of late submissions, the penalty amounts to either 0.5% of your total sales, turnover, or gross receipts, or Rs 1.5 lakh, whichever is lower. If you operate a business and have missed deadlines, you will incur a penalty, which will be deducted from your earnings.

Is there any way to avoid the penalty?

If you have a valid reason for the delay, the Assessing Officer (the tax official reviewing your documents) has the discretion to waive the penalty for the late audit report. However, even in such cases, you will still be liable to pay the penalty for not filing your Income Tax Return (ITR) on time.

What If The Penalty is not paid?

Failing to submit the audit report and neglecting to pay the penalty will result in the Income Tax Department treating it as if you have not filed your Income Tax Return (ITR). In such a case, you may receive a notice from the tax department to rectify your ITR. If you do not address your ITR issues promptly, you could potentially face additional penalties, especially if you also owe unpaid taxes.
